TERMS OF SERVICE

By creating an account, accessing, or using TheMarsSpace.com, SpacePiff.com, or any associated services (collectively, "the Platform"), you agree to be bound by these Terms of Service ("Terms"). The Platform is operated by Space Weed Universe ("we," "us," "our"). If you do not agree to these Terms, do not use the Platform.

You must be at least 18 years of age to create an account or use the Platform. By registering, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

The Platform is intended for adults. We do not knowingly collect information from, or direct content to, individuals under the age of 18. If we become aware that a user is under 18, we will terminate the account and delete associated data.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately of any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms or pose a security risk.

You may create multiple character profiles under a single account. All profiles share the account's authentication credentials and are subject to these Terms.

Your Content: You retain full ownership of all original content you upload, transmit, or create on the Platform, including music, art, text, profile information, and wall comments ("User Content").

License to Us: By posting User Content, you grant Space Weed Universe a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, distribute, and transmit your User Content solely for the purpose of operating, promoting, and improving the Platform. This license continues for as long as your content is on the Platform and ends when you delete it (except for copies made by other users or cached versions).

Representations: You represent that you own or have the necessary rights to share all User Content, and that your content does not infringe on any third party's intellectual property, privacy, or other rights.

Generation: The Platform uses artificial intelligence to generate character avatars ("Martian Avatars") based on canonical species reference images and user-selected customization options. Martian Avatars are generated using third-party AI image generation services.

Ownership: You own the specific Martian Avatar generated for your character profile. However, the underlying species design, reference characters (Emilio the Martian, Queen ET), art direction, and species intellectual property remain the exclusive property of Space Weed Universe.

License: You grant Space Weed Universe a perpetual, non-exclusive license to display your Martian Avatar within the Platform ecosystem, including on public profile pages, the Recent Recruits gallery, and promotional materials for the Platform.

Limitations: Each character is limited to 3 avatar regenerations. This limit exists to manage computational resources and prevent abuse. We reserve the right to modify regeneration limits at any time.

User Prompts: Any text descriptions ("user prompts") you provide to customize your avatar generation are subject to the same content guidelines as User Content. Prompts that violate community guidelines may result in generation failure or account action.

No Guarantee: AI generation results may vary. We do not guarantee that generated avatars will match your exact expectations. Generated images may be reviewed and replaced by administrators for quality or compliance purposes.

You agree to conduct yourself in a manner consistent with our creative community values. You may not:

We reserve the right, but are not obligated, to review, monitor, and remove any User Content at our sole discretion. We may remove content that violates these Terms, community guidelines, or applicable law without prior notice.

Administrators may replace AI-generated avatars or modify user profiles if content is deemed inappropriate, off-brand, or in violation of platform guidelines.

Public Profiles: Your Martian character profile (name, avatar, role, bio) is publicly visible at a unique URL. By creating a profile, you consent to this information being publicly accessible.

Wall Comments: Comments posted on public walls are visible to all users. You are responsible for the content of your comments.

Friend Connections: Friend/connection features display mutual relationships publicly on profile pages.

SpacePiff.com is the Platform's music sharing service. All audio content uploaded must be:

We will remove infringing content upon proper notice. Repeated copyright violations may result in account termination.

The Mars Space, Space Weed Universe, SpacePiff, the Martian species design, Emilio the Martian, Queen ET, and all associated branding, logos, art, and creative assets are the intellectual property of Space Weed Universe. You may not reproduce, modify, distribute, or create derivative works from our intellectual property without written permission.

We may suspend or permanently terminate your account at any time, with or without notice, for any reason including but not limited to violation of these Terms. You may request account deletion by contacting us at highcommand@spaceweeduniverse.com.

Upon termination, your license to use the Platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPACE WEED UNIVERSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration administered under the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits.

For informal resolution, contact us first at highcommand@spaceweeduniverse.com. We will attempt to resolve disputes within 30 days before either party initiates arbitration.

Space Weed Universe and The Mars Space are entertainment and creative community brands. The Platform does not sell, distribute, facilitate the sale of, or promote the use of any controlled substances.

Any references to "weed," "space weed," or related terminology within the brand, lore, or community context are part of a fictional creative universe and do not constitute endorsement, promotion, or facilitation of cannabis or any controlled substance.

Users are responsible for complying with all applicable local, state, and federal laws in their jurisdiction.

You agree to indemnify, defend, and hold harmless Space Weed Universe, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Platform, your User Content, or your violation of these Terms.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any legal proceedings shall take place in the courts of Los Angeles County, California.

We may update these Terms at any time. We will notify users of material changes via the Platform. Continued use after changes constitutes acceptance of the updated Terms. If you disagree with changes, you must stop using the Platform.
